BCTN Terms & Conditions

Service Level
For the transport services of BCTN a Service Level has been defined and added to the agreement in which the leadtimes for transport is shown. In this document the Service Levels and the applicable conditions are established. The client is responsible for providing the correct Start Leadtime, as defined in the Service Level, unless agreed otherwise. Change fees are applicable for any changes after the defined Start Leadtime. The BCTN bookingconfirmation is binding to the transport order.

Congestion and Delays
When a seaport moves the agreed timewindow by more than three hours, BCTN reserves the right to bypass this seaport in order to protect the sailing schedule and the Service Levels of the other cargo on board. Deadfreight will be applicable for the cargo destined for this seaport. Deadfreight will be charged to the client and not to the seaport. In the event of sustained congestion in one or more seaports a congestion charge is applicable which will be communicated separately.

Detention and Demurrage
BCTN does not have any responsibility regarding detention and demurrage, neither will BCTN accept any claim for compensation or other forms of indirect costs.

Approving quotation
When the quotation is accepted and approved, all previous quotations regarding a specific cargo flow are terminated. If a quotation is updated during the contract period, an approval is only required for the updated part of the quotation. The rest of the quotation, including all rates and conditions, remains valid.

Payment terms
Payment of our invoices has to be completed within 30 days after the invoice date. For invoices for customs services a payment term of 7 days after the invoice date is applicable. BCTN reserves the right to carry out a credit check before accepting a transport order and to alter the payment terms per quotation accordingly.

Dangerous Goods
The transport and storage of dangerous goods can be arranged via the BCTN terminals equiped for handling dangerous goods (IMO class 1 and 7 are excluded). The accompanying documentation is arranged and paid for by the client. The transport order becomes definitive when all documentation is present at the seaport.

Fuel Surcharge
All our transports are subject to a fuel surcharge. This fuel surcharge is determined monthly and distributed in writing. If a client wants to be added to the distribution list an email should be sent to facturatie@bctn.nl for the Dutch terminals or to mtessens@bctn.eu for the Belgian terminals. This quotation is subject to the fuel surcharge relevent for the terminal on which the quotation is based.

Releases and information
The release of the container(s), the customs documentation and/or the additional transport documentatrion and other required information are to be arranged and paid for by the customer, be it provided before the Start Leadtime as defined in the Service Level. This includes the electronic registration of customs documentation at the seaport. When the container(s) is not released in the seaport free from any fault of our companies, a deadfreight surcharge will be charged to the client as compensation for the reserved space onboard our vessel.

Required date for bookings
In attachement BCTN Service Level the information is shown that BCTN requires from the client to complete a booking. The Service Level is only applicable when a booking is complete.

Booking confirmation
By sending a booking the client commits to the transport order for BCTN. For this a complete booking is not necessary. Acceptation of the transport order is done once a (conditional) booking confirmation is sent. The booking confirmation is validated providing all conditions as determined in the Service Level are met. The client is responsible for providing and maintaining the contact information.

Customs
All BCTN terminals have an independent customs warehouse. When a document expires the client can request that BCTN enters the container into the customs warehouse. The client is at all times responsible for the validity of documentation, the correctness of the documentation, the appreciation and pricing of the goods, as well as the insurance of the goods. The client commits to sharing this information with BCTN upon the first request.
